    DRAFTPASS UK SUBSCRIPTION – TERMS AND CONDITIONS  

    1. INFORMATION ABOUT US 
    1. We operate the website https://perfectdraft.com/en-gb (the “Site”). We are PerfectDraft UK Limited, a company registered in England and Wales under company number 08118833 and with our registered office at Fetter Lane, EC4A 1EN. Our VAT number is 143 9594 82.

    1. HOW WE USE YOUR PERSONAL INFORMATION 
    1. We only use your personal information in accordance with our Privacy Policy. Please take the time to read our Privacy Policy, as it includes important terms which apply to you. 

     

    1. DRAFTPASS SUBSCRIPTION; ELIGIBILITY, PRICE and PAYMENT 
    1. These terms and conditions (hereinafter, “DraftPass Terms”) apply to DraftPass, a subscription service that gives you access to a series of perks related to PerfectDraft, as described on our Site.  
    1. The DraftPass perks are: 
    • 10% off all keg orders on our Site. This will be in the form of a unique discount code that you will receive after you have subscribed. This discount code is not cumulative with other offers available on site and/or on the PerfectDraft App and you will need to be logged in into your PerfectDraft account to use it. 
    • Next day delivery: this is available for all delivery addresses in mainland England, Wales and Scotland in the Yodel 24h zone, and applies only to orders placed before 4:00pm on the day before the delivery date, Mon-Thurs only. 
    • Exclusive access to new keg and merch releases: subscribers will get an advance notice on new releases of minimum 4 (four) hours on the email address they used for the creation of their PerfectDraft account. 
    1. To make use of your DraftPass perks, after subscribing, you must be logged in in your PerfectDraft account linked to the email address that you have used to subscribe. 
    1. You are eligible to subscribe to DraftPass if you are a UK resident, aged 18+, and have a PerfectDraft account. We are not allowed by law to supply goods to you if you do not satisfy legal age requirements. If you are underage, please do not attempt to subscribe to DraftPass and cease to use the site immediately. 
    1. The maximum number of DraftPass subscriptions available is 200, available on a first come first served basis. 
    1. The price of the DraftPass subscription is GBP10 per month, billed monthly for the whole duration of the Minimum Term as defined hereinafter. 
    1. After placing your order, you will receive an automated order acknowledgement. Please note that this does not mean that your order has been accepted. All orders are subject to acceptance by US. 
    1. You will receive an email confirming that we have accepted your order when your order has been processed and is confirmed. You will also receive your exclusive and personal discount code. 
    1. We retain the right to refuse any order. 
    1. Payments will be processed by Recurly. Please visit https://recurly.com/legal/terms/ to access Recurly’s terms and conditions. 
    1. You will pay immediately for the first month of your DraftPass subscription. For the following months, you will be billed every 30 days from the day of the first payment for the duration of the Minimum Term. 
    1. We reserve the right to change the perks subject to availability and giving notice at least 30 days in advance by posting an update on our Site. 

     

    1. MINIMUM TERM 
    1. DraftPass subscription has a minimum term of 12 months (“Minimum Term”). 
    1. It is not possible to unsubscribe before the end of the Minimum Term. 
    1. After the end of the Minimum Term, your subscription will end automatically and you will not be charged. 

     

    1. DISCOUNT ON PERFECTDRAFT MACHINES BUNDLE WHEN YOU SUBSCRIBE FOR THE MINIMUM TERM 
    1. When subscribing to DraftPass for the Minimum Term, you can unlock a special discount on a Philips PerfectDraft machine or a PerfectDraft Pro machine bundle of your choice, subject to availability.  
    1. A description of each PerfectDraft machine is available on our Site https://www.perfectdraft.com/en-gb/perfect-draft-range/perfect-draft. 
    1. The discounted bundles include one PerfectDraft machine and a free keg of your choice from a selection of kegs, both subject to availability. 
    1. The discounted price for the Philips PerfectDraft machine bundle when subscribing to DraftPass for the Minimum Term is GBP139, instead of £290. 
    1. The discounted price for the PerfectDraft Pro machine bundle when subscribing to DraftPass for the Minimum Term is GBP£280, instead of £400. 
    1. You will be able to select one of the two bundles when subscribing with DraftPass. Payment for the machine bundle is to be performed in advance. 

     

    1. RIGHT OF TERMINATION 
    1. As a consumer, you have a legal right to cancel a contract during the period set out below in Clause 8.3 of our general Terms & Conditions. Please refer to Clause 8 of our Terms and Conditions for further information on this right. 
    1. If you cancel your subscription within the period mentioned above, you must either 
    • Return without delay the PerfectDraft machine bundle purchased at the discounted price available to DraftPass subscribers, or 
    • Pay the full price for the PerfectDraft machine bundle of your choice within 7 days from the cancellation of the subscription. Our customer service will be in contact with you to give you the instructions to complete the payment. 

     

    1. INDEMNITY 
    1. You agree to indemnify and hold PerfectDraft harmless from and against any breach by you of these Terms and any claim or demand brought against PerfectDraft by any third party arising out of your use of the site and the DraftPass subscription, including without limitation, all claims, actions, proceedings, losses, liabilities, damages, costs, expenses (including reasonable legal costs and expenses) howsoever suffered or incurred by PerfectDraft in consequence of your breach of these Terms. 
    1. If you unsubscribe before the end of the Minimum Term, the full amount of the DraftPass Subscription for the whole Minimum Term will become immediately due to PerfectDraft UK. In that case, we retain the right to ask for an immediate full payment of any remaining amount. 

     

     

    1. GENERAL 
    1. Our General Terms and Conditions apply to your purchase of the PerfectDraft machine and Keg bundle, and any other subsequent order. 
    1. In case of discrepancies between our General Terms and Conditions and these Terms and Conditions, the latter will prevail. 
    1. Prices and offers may vary and may only be available for limited periods. All prices and offers are subject to availability and may be withdrawn or amended at our discretion. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the products. 
    1. The 10% discount code is strictly personal and can be used exclusively by the relevant subscriber. We reserve the right to withdraw it in case we suspect this code has been shared with unauthorized third parties.
